Electric car charging point terms

in force from 29 March 2023 · Applies to the charging point in the car park of Hotel & SPA Jawor in Zawoja.

Section 1

• These terms (the “Terms”) were drawn up on 29 March 2023 and govern the use of the electric car charging point in the car park of Hotel & SPA Jawor in Zawoja, 34-222 Zawoja 1847 (the “Car Park”).
• The Terms were adopted by the management board of Jama-Tour Marek Kukla S.K.A., which owns Hotel & SPA Jawor (the “Hotel”). The Terms may be changed at any time.
• There is one marked electric car charging point in the Car Park. It is intended for electric passenger cars of any make.
• The Terms apply to everyone using the Charging Point. People and cars in breach of the Terms may be removed from the Charging Point by the Hotel.
• By driving up to the Charging Point, a driver accepts the Terms, undertakes to follow them and is answerable to the Hotel for doing so.

Section 2

• The Charging Point may be used around the clock, every day of the week.
• Charging can start once you have contacted hotel reception.
• The charging points are intended solely for charging electric passenger cars, that is cars with an electric drive, and must not be used for parking cars or other vehicles.
• Price list for the electric car charging point: PLN 3.00 per kWh.
• The Hotel may at any time stop the Charging Point being used by people who are not entitled to use it and are not using the hotel’s services.

Section 3

• The basic rules for using the Charging Point are:

  • – using the Charging Point only while the car is charging,
  • – the driver of the car plugging the Charging Point connector into it themselves,
  • – parking the car at the Charging Point, immobilising it, switching off the engine and lights, closing the windows, doors and boot,
  • – the driver of the vehicle securing it against theft or break-in themselves,
  • – leaving the Charging Point connector in the place provided once charging is finished.
• The Charging Point must not be used by:

  • – cars carrying flammable, corrosive or explosive materials, or other similar materials and substances that could endanger people or property,
  • – cars serving as mobile shops, where the intention is to trade in the Car Park,
  • – cars with combustion engines, including hybrids with no charging function.
• Animals must not be left in a car at the Charging Point.

Section 4

• Any interference with the technical infrastructure of the Charging Point is forbidden.
• Report any fault in the Charging Point, and any doubt about how to use it, to hotel reception straight away.

Section 5

• The Operator is not liable:

  • – for the consequences of using the Charging Point other than as intended or other than under the Terms,
  • – for any interruption in the operation of the Charging Point; the Charging Point may be taken out of service at any time, temporarily or permanently,
  • – for any loss arising from force majeure, theft (break-in, robbery and the like), destruction of or damage to cars at the Charging Point, or to items left in them or forming part of their equipment,
  • – for the acts of third parties.

Section 6

• Where a user breaches the Terms, the Hotel may take the steps needed to restore compliance with them, including by removing the car from the Charging Point or fitting a wheel clamp.
• In the cases set out in paragraph 1 of this Section, the user of the car is to cover the costs of removing the car from the Charging Point and of securing and storing it until the user collects it, by paying a charge of PLN 500.
• The user is liable for any damage caused by the vehicle or arising in connection with use of the Charging Point.
